1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client”, “you”) and Hippie Trek Nepal (“Hippie Trek”, “we”, “us”) governing your use of https://hippietreknepal.com and your booking of any trekking package, guiding service, or related service (collectively, the “Services”). By booking a trek or using the Site, you agree to be bound by these Terms in full.

2. Bookings

1. A booking is confirmed upon receipt of the required deposit and written confirmation from Hippie Trek. A trek is not guaranteed until confirmation has been issued.
2. You are responsible for ensuring that all personal information provided at the time of booking, including passport details and medical information, is accurate and complete.
3. Hippie Trek reserves the right to decline a booking at its sole discretion, including where a Client’s health, fitness, or experience level appears unsuitable for the selected trek.

3. Trip Modifications

Hippie Trek reserves the right to modify an itinerary before or during a trek where necessary due to weather conditions, government restrictions, trail conditions, health and safety concerns, or circumstances beyond our reasonable control. Where reasonably possible, we will notify you of material changes in advance. No refund is owed for itinerary modifications made for safety reasons.

4. Client Responsibilities

1. You are responsible for arriving at the trek departure point in suitable physical condition for the selected trek’s difficulty rating.
2. You are responsible for obtaining valid travel insurance covering high-altitude trekking, emergency medical treatment, and evacuation, as further described in our Refund and Cancellation Policy.
3. You agree to follow the reasonable instructions of your assigned guide at all times, particularly regarding safety, pace, and acclimatization decisions.
4. You agree to respect local customs, communities, and environmental guidelines, including Leave No Trace principles, throughout your trek.

5. Health and Fitness

Trekking in Nepal, particularly at high altitude, carries inherent physical risk, including but not limited to altitude sickness. You confirm that you are physically fit to undertake the selected trek and will disclose any pre-existing medical conditions at the time of booking. Hippie Trek guides are trained in high-altitude first aid but are not a substitute for professional medical care.

6. Assumption of Risk

You acknowledge that trekking in mountainous terrain involves inherent risks, including but not limited to altitude-related illness, adverse weather, difficult terrain, and remote emergency response times. You voluntarily assume these risks by booking a trek with Hippie Trek.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Hippie Trek Nepal shall not be liable for any indirect, incidental, or consequential loss arising from your participation in a trek, including loss resulting from delay, itinerary change, illness, injury, or circumstances beyond our reasonable control. Nothing in these Terms limits liability that cannot be excluded under applicable law.

8. Force Majeure

Hippie Trek shall not be held responsible for any failure to perform its obligations where such failure results from circumstances beyond its reasonable control, including natural disaster, extreme weather, government action, epidemic, civil unrest, or closure of trekking routes or borders.

9. Intellectual Property

All content on the Site, including text, images, logos, and design elements, is the property of Hippie Trek Nepal or its licensors and is protected by applicable intellectual property law. No content may be reproduced without prior written consent.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

11. Amendments

Hippie Trek reserves the right to amend these Terms at any time. Amendments will be posted on this page with an updated Effective Date. Continued use of the Site or Services following any amendment constitutes acceptance of the revised Terms.
